Plant Identifier: Care Plant

Effective Date: March 7, 2026

These Terms of Service (“Terms”) govern your use of the mobile application Plant Identifier: Care Plant (the “App”) provided by Xylo Solution LLC (“Company,” “we,” “us,” or “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes on a device you own or control, in accordance with these Terms and the applicable app-store rules (Apple App Store and Google Play Store).

2. User Content – Plant Photos

You may capture or upload photos of plants.

You represent and warrant that you have all necessary rights to submit those photos and that they do not infringe any third-party rights or violate any law.

By submitting a photo, you grant us a limited license to transmit it to OpenAI’s API solely for the purpose of providing the identification service.

We do not claim ownership of your photos.

3. Prohibited Conduct

You agree not to:

• Reverse-engineer, decompile, or attempt to discover the source code of the App.
• Use the App for any illegal purpose or to identify protected or endangered plants in violation of applicable law.
• Upload photos that are obscene, defamatory, or infringe third-party rights.
• Interfere with the App’s operation or security measures.

4. Intellectual Property

The App, its design, logos, and all underlying technology (excluding OpenAI models) are owned by Xylo Solution LLC or its licensors and are protected by copyright and other intellectual-property laws.

5. Third-Party Services

The App relies on:

• OpenAI API for plant identification – subject to OpenAI’s Terms of Use and Privacy Policy.
• Google Firebase Analytics – subject to Google’s Terms and Privacy Policy.

You are responsible for reviewing and complying with those third-party terms.

6. Disclaimers

THE APP AND ALL PLANT IDENTIFICATION RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND.

• Plant identification is powered by artificial intelligence and is for informational and entertainment purposes only.
• Results may be inaccurate or incomplete.
• Never use the App to determine whether a plant is edible, medicinal, poisonous, or safe to touch.
• Always consult a qualified expert or reliable field guide.
• We do not guarantee continuous, error-free, or secure operation of the App.

7. Limitation of Liability

To the maximum extent permitted by law, Xylo Solution LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.

Our total liability to you shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

8. Termination

We may suspend or terminate your access to the App at any time, with or without cause, including if we believe you have violated these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles.

Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.

10. Changes to the Terms

We may modify these Terms from time to time.

We will post the revised version with a new Effective Date.

Your continued use of the App after the changes become effective constitutes your acceptance of the revised Terms.
